This work, in English "Struggle for power, organic crisis and judicial independence", has its origin in research academics of the IAEN carried out to provide expert advise to the Inter American Court of Human Rights in the case Quintana and others (Supreme Court of Justice) vs the State of Ecuador. The research is about the nature of the evolution of the ecuadorian state, the dynamics of its institutions, its players, parties, laws, its factors of instability, the way rights have been (...) deployed since the return to democracy in 1979, those who have benefited from neoliberal democracy and those who have paid the costs, and where in all this was the Supreme Court of Justice. The Introduction takes a look at this origin of the work and its intellectual import, provides a brief characterization of the Inter American Sistem of Human Rights Protection, how the Quintana Case fits within it, and an overview of the chapters and their logic. The first chapter analyzes the institutional and sociological factors that have contributed to Ecuador's historically unstable state, based primarily in an antagonistic struggle for power between the Executive and Legislative branches. The second chapter analyzes the economic and political factors that provoked an organic crisis, or crisis of hegemony, between 1997 and 2007 in Ecuador. The third chapter analyzes the evolution of the way in which judges are selected in Europe, the outcomes they have generated, and how they compare with the ecuadorian systems of judge selection in terms of securing judicial independence. The fourth chapter develops a theory of judicial independence in democracy and analyzes how Ecuador measures up to that standard, from when it became a neoliberal minimal democracy in 1981, to when it became a neoliberal false democracy as a consequence of instalation of a system evidently lacking in the people's support under the guise of the 1998 Constitution and its system of judge selection, and the new democratic horizons set by the 2008 Constitution, and the judicial system that springs from it. Las lecciones inaugurales son una clásica tradición en la Universidad Antonio Ruiz de Montoya, con ellas se da inicio al año académico. Para estas ocasiones, el Consejo Universitario designa a un profesor del claustro que tendrá el honor de pronunciar la lección inaugural. Allí, el catedrático ofrece una clase magistral en la que da cuenta de una investigación reciente, o vuelve sobre el trabajo académico al que ha dedicado años, o reflexiona sobre asuntos de importancia, ya sea del ámbito (...) universitario o de la actualidad nacional. Al cumplirse veinte años de nuestra universidad, y en un momento de crecimiento y consolidación, es importante mantener el vínculo con los tiempos fundacionales para observar el camino recorrido y preparar la senda para todo lo que viene. This essay frames systemic patterns of mental abuse against women of color and Indigenous women on Turtle Island (North America) in terms of larger design-of-distribution strategies in settler colonial societies, as these societies use various forms of social power to distribute, reproduce, and automate social inequalities (including public health precarities and mortality disadvantages) that skew socio-economic gain continuously toward white settler populations and their descendants. It departs from traditional studies in gender-based violence research that frame mental abuses such as gaslighting--commonly (...) understood as mental manipulation through lying or deceit--stochastically, as chance-driven interpersonal phenomena. Building on structural analyses of knowledge in political epistemology (Dotson 2012, Berenstain 2016), political theory (Davis and Ernst 2017), and Indigenous social theory (Tuck and Yang 2012), I develop the notion of cultural gaslighting to refer to the social and historical infrastructural support mechanisms that disproportionately produce abusive mental ambients in settler colonial cultures in order to further the ends of cultural genocide and dispossession. I conclude by proposing a social epidemiological account of gaslighting that a) highlights the public health harms of abusive ambients for minority populations, b) illuminates the hidden rules of social structure in settler colonial societies, and c) amplifies the corresponding need for structural reparations. This paper argues that there is a class of terms, or uses of terms, that are best accounted for by an expressivist account. We put forward two sets of criteria to distinguish between expressive and factual terms. The first set relies on the action-guiding nature of expressive language. The second set relies on the difference between one's evidence for making an expressive vs. factual statement. We then put those criteria to work to show, first, that the basic evaluative adjectives such (...) as ‘good’ have expressive as well as factual uses and, second, that many adjectives whose primary meanings are factual, such as ‘powerful’, also have expressive uses. This paper is a follow-up of the first part of the persons reply to the Chinese Room Argument. The first part claims that the mental properties of the person appearing in that argument are what matter to whether computational cognitive science is true. This paper tries to discern what those mental properties are by applying a series of hypothetical psychological and strengthened Turing tests to the person, and argues that the results support the thesis that the Man performing the computations (...) characteristic of understanding Chinese actually understands Chinese. The supposition that the Man does not understand Chinese has gone virtually unquestioned in this foundational debate. The persons reply acknowledges the intuitive power behind that supposition, but knows that brute intuitions are not epistemically sacrosanct. Like many intuitions humans have had, and later deposed, this intuition does not withstand experimental scrutiny. The second part of the persons reply consequently holds that computational cognitive science is confirmed by the Chinese Room thought experiment. (shrink)

There is a growing trend across North America of women being criminalized for their pregnancy outcomes. Rather than being a series of aberrations resulting from institutional failures, we argue that this trend is part of a colonial strategy of administrative violence aimed at women of color and Native women across Turtle Island. We consider a range of medical and legal practices constituting gender-based administrative violence, and we argue that they are the result of non-accidental and systematic production of population-level harms (...) that cannot be disentangled from the goals of ongoing settler occupation and dispossession of Indigenous lands. While white feminist narratives of gender-based administrative violence in Latin America function to distance the places where such violence occurs from the ‘liberal democratic’ settler nation-states of the U.S. and Canada, we hold that administrative forms of reproductive violence against Latin American women are structurally connected to efforts in the U.S. and Canada to criminalize women of color and Indigenous women for their reproductive outcomes. The purpose of these systemically produced harms is to sustain cultures of gender-based violence in support of settler colonial configurations of power. (shrink)

Intersectionality is a term that arose within the black feminist intellectual tradition for the purposes of identifying interlocking systems of oppression. As a descriptive term, it refers to the ways human identity is shaped by multiple social vectors and overlapping identity categories (such as sex, race, class) that may not be readily visible in single-axis formulations of identity, but which are taken to be integral to robustly capture the multifaceted nature of human experience. As a diagnostic term, it captures the (...) confluence of power and domination on the social construction of identity in order to remedy concrete harms that result from this convergence. It is not a prescriptive methodology or closed system of analysis, but rather an open-ended hermeneutic lens through which interconnected systems of oppression can come into focus in the fight for social justice. Panentheism has seen a revival over the past two decades in the philosophical literature. This has partially triggered an interest in Indian models of God, which have traditionally been seen as panentheistic. On the other hand, panentheism has been often associated with panpsychism, an old ontological view that sees consciousness as fundamental and ubiquitous in the natural world and which has also enjoyed a renaissance in recent decades. Depending on where one places fundamentality (whether on the microlevel or on the (...) cosmic-level) there will be two types of panpsychism: micropsychism and cosmopsychism. Despite the apparently rich connection between Indian traditions and panpsychism, especially in its cosmopsychist version, recent work within cross-cultural analytic philosophy of mind seems to be mostly focused on atheistic traditions, such as Advaita Vedānta and Buddhism. My goal in this paper is to contribute to the cross-cultural debate over panentheism and Indian models of God, as well as to the debate on the connections between panpsychism, cosmopsychism and Indian traditions, by examining one of the most important and often quoted texts in Indian religious and philosophical traditions: the theistic Bhavagad Gītā. From a more specific standpoint, the paper has a threefold goal: to offer a panentheistic reconstruction of the Gītā’s concept of God, to show how this panentheistic model of God entails a form of theistic cosmopsychism, and to locate the Gītā’s cosmopsychism within a broader map of cosmopsychist views. Based on this reconstructive analysis of the Gītā’s cosmopsychism, I also outline some few reflections on the philosophical prospects of theistic cosmopsychism. (shrink)

El Realismo Científico Estándar sostiene el enfoque metafísico de que el mundo es como es independiente de la mente. Sin embargo, el presente artículo demuestra cómo esta postura es incompatible con todas las teorías no-eliminativistas sobre la mente, lo cual hace que la postura sea inconsistente, incompatible con la ciencia, elimina la consciencia, la intencionalidad, la causación mental y la ética. Se propone una tesis realista alternativa que conserva la idea de que el mundo en general es de la forma (...) que es, independiente de lo que pensemos sobre él, compatible con la mente como parte real del mundo. Este cambio restaura la posibilidad de consistencia, la mente, la consciencia, la intencionalidad, la ciencia y la ética. -/- Standard Scientific Realism holds the metaphysical view that the world is the way it is independent of the mind. However, this paper demonstrates how this view is incompatible with all non-eliminativist theories of mind, leading it to be inconsistent, incompatible with science, and eliminating consciousness, intentionality, mental causation and ethics. An alternative realist thesis is proposed which preserves the idea that generally the world is the way it is independent of what we think of it, compatible with mind as a real part of the world. This reform restores the possibility of consistency, mind, consciousness, intentionality, science and ethics, while at the same time preserving the theoretical advantages over non-realist competitors. Any plausibly just market exchange must balance two conflicting moral considerations: non-worseness (Wertheimer, 1999) and euvoluntariness (true voluntariness; Munger, 2011). We propose an analytical theory of just market exchange that partly resolves this conflict.

Este texto pretende dar respuestas a la pregunta acerca de (y justificar) la importancia de la filosofía de Max Stirner, principalmente expuesta en El Único y su propiedad, en el curso de la historia de la filosofía, y, por ende, la conveniencia de su conocimiento, esto es, su investigación y estudio.

In this paper I try to answer four basic questions: (1) How the concept of God is to be represented? (2) Are there any logical principles governing it? (3) If so, what kind of logic lies behind them? (4) Can there be a logic of the concept of God? I address them by presenting a formal-logical account to the concept of God. I take it as a methodological desideratum that this should be done within the simplest existing logical formalism. I (...) start with first-order logic (FOL) with identity, and then show that its simplest modal extension (SQML, or the simplest quantified modal logic) is enough for us to formalize a minimally satisfactory theory of the concept of God. A credible fear test is an in-depth interview process given to undocumented people of any age arriving at a U.S. port of entry to determine qualification for asylum-seeking. Credible fear tests as a typical immigration procedure demonstrate not only what structural epistemic violence looks like but also how this violence lives in and through the design of asylum policy. Key terms of credible fear tests such as “significant possibility,” “evidence,” “consistency,” and “credibility” can never be neutral in the context of (...) colonial administrative violence. We argue that these terms function as mechanisms of exclusion and demonstrate that the capacity to be violent (i.e. to be an instrument of violence) is built into these tests, ready to be deployed when an administration wants to stop certain people from certain places from entering without regard to their own ongoing occupation of Indigenous lands. Not only are such practices instruments of violence, but the concept of ‘violence’ continues to be organized, defined, and conceived within settler colonial epistemologies so as to exclude these administrative forms of violence deployed against Indigenous peoples and people of color from recognition and nameability. We argue that this is an intentional strategy of colonial power preservation that is functionalized through social processes that remain structurally stable and self-regenerating across historical and political changes. When faced with the charge that a given concept of God is contradictory, the standard move among philosophers and theologians has been to try to explain away the contradiction and show that the concept of God in question is consistent. This has to do, of course, with the Law of Non-Contradiction (LNC). Another option, which has recently generated interest among logicians and analytic philosophers of religion, is to reject such a move as unnecessary and defend what might be called the (...) contradictory God thesis. To be sure, something close to that can be found in philosophers such as Pseudo-Dionysius, Thomas Aquinas and Nicolaus de Cusa. However, it is only recently that this approach has gained momentum, certainly driven by the contemporary advance of dialetheism and glut theoretic approaches in general, and paraconsistent logic. Needless to say, a standard move among defenders of the contradictory God thesis is to challenge the LNC. The argumentation, however, is seldomly framed in conceptual terms. Instead, it is mostly framed in ontological terms, as God being a contradictory entity. From this perspective, the contradictory God thesis is the thesis that God is a contradictory object. My goal in this paper is to provide a conceptual assessment of the discussion surrounding the contradictory God thesis. To achieve this, I make use of a general and hopefully non-controversial meta-theory of concepts and adopt a semantic approach rather than a metaphysical one. Within this framework, I address the following questions: What are the different ways we can understand the contradictory God thesis? What grounds are there for rejecting a contradictory concept of God? What standard moves are available to defend oneself from such criticisms and how do they relate to the LNC? What challenges do they present? As a secondary goal, the paper introduces a novel defense of the contradictory God thesis, drawing on a specific interpretation of the theology of the 16th-century Indian thinker Jīva Gosvāmī, which avoids the need to challenge the LNC. I term this approach ‘non-dialetheic mystical contradictory theism.’. (shrink)

Inspired by the early Wittgenstein’s concept of nonsense (meaning that which lies beyond the limits of language), we define two different, yet complementary, types of nonsense: formal nonsense and pragmatic nonsense. The simpler notion of formal nonsense is initially defined within Tarski’s semantic theory of truth; the notion of pragmatic nonsense, by its turn, is formulated within the context of the theory of pragmatic truth, also known as quasi-truth, as formalized by da Costa and his collaborators. While an expression will (...) be considered formally nonsensical if the formal criteria required for the assignment of any truth-value (whether true, false, pragmatically true, or pragmatically false) to such sentence are not met, a (well-formed) formula will be considered pragmatically nonsensical if the pragmatic criteria (inscribed within the context of scientific practice) required for the assignment of any truth-value to such sentence are not met. Thus, in the context of the theory of pragmatic truth, any (well-formed) formula of a formal language interpreted on a simple pragmatic structure will be considered pragmatically nonsensical if the set of primary sentences of such structure is not well-built, that is, if it does not include the relevant observational data and/or theoretical results, or if it does include sentences that are inconsistent with such data. In this chapter, Ricardo Silvestre and Alan Herbert offer a reconstruction of the Gītā’s concept of God with a focus on the relationship between God and the world. They try to explain the claim that the Gītā is panentheistic. This is done with the help of some key notions of contemporary metaphysics (such as ontological dependence and fundamentality) along with the Indic notion of prakṛti, considered as a metaphysical primitive denoting the intimate relationship that exists between matter and conscious (...) living beings on the one hand, and God on the other. This paper aims to perform a possible heuristic analysis of the film "The Exterminating Angel" (El Angel Exterminador) – produced in 1962 by the Hispanic Mexican director Luís Buñuel – through the platonic thought present in the books: "The Symposium" (Συμπόσιον), and "Republic" (Πολιτεία). It also presents an argument on the film's scriptural, artistic, and historical characteristics, such as some /intersections of its aesthetic movement, the Surrealism – specific correlations with Breton and Benjamin will also be made. It is a fact that there is ethical criticism about art. Art critics, the general public and even artists point out moral flaws in artworks while evaluating them. Philosophers, however, have maintained a hot debate on the meaning of such criticism. This debate can be understood as a disagreement about the kind of relation between the artistic value of artworks and their alleged moral value. While some claim that moral value can contribute to artistic value (moralism), others claim that there (...) cannot be such a contribution (autonomism). Since at least some works of architecture are artworks, that debate also concerns architecture. A moderate moralist view claims that some works of architecture have moral flaws/merits that bear on their artistic evaluation. In an apparently promising version, the contention is that some moral flaws/merits are aesthetically relevant. In this paper I argue against such contention and defend an autonomist view. Following some taxonomy remarks I distinguish the views in the debate and present two points in favour of autonomism: its simplicity and not having the burden of proof. Then I discuss Carroll’s merited response argument for moralism and I argue that in its best interpretation either it begs the question against autonomism or it is compatible with it. I conclude with some possible objections that may help further investigations on the subject. (shrink)

This paper suggests the democratic direction in which the right of freedom of expression should be conceived and applied. In the first two sections it suggests some counter-examples to, and diagnoses of, the libertarian and liberal conceptions of freedom of expression, taking Scanlon (1972) and Scanlon (1979), respectively, to be their chief proponents. The paper suggests that these conceptions cannot take into account clear examples, like fraudulent propaganda, which should not be legal. The democratic conception takes it to heart that (...) the pillars upon which the right of freedom of expression is founded are individual and collective autonomy, the right to know facts of public interest and information necessary for effective democratic control of government. The paper suggests that in a time when private powers seriously threaten these pillars, it is correct for the government to step in to provide the framework in which genuine discussion geared toward fulfilling the objectives of these pillars can take place. Most words in natural language are vague, that is to say, they lack sharp boundaries and, hence, they have (actual or potential) borderline cases, where the word in question neither definitely applies nor definitely fails to apply. Vagueness gives rise to paradoxes, the best known of which is the sorites (concerned with how many grains of sand are needed to make a heap). Besides offering a solution to such paradoxes, a theory of vagueness should systematically describe how the truth conditions (...) of sentences with vague terms are determined; and it should also define the right logical principles for reasoning with such sentences. Gender-based forms of administrative violence, such as reproductive violence, are the result of systems designed to enact population-level harms through the production and forcible imposition of colonial systems of gender. Settler statecraft has long relied on the strategic promotion of sexual and reproductive violence. Patterns of reproductive violence adapt and change to align with the enduring goals and evolving needs of settler colonial occupation, dispossession, and containment. The U.S. Supreme Court’s recent decision to end the constitutional right to abortion in (...) Dobbs v Jackson is but one instance of this larger pattern. We analyze reproductive and obstetric violence and the structural trauma they produce through the lenses of i) historical continuity and ii) the global architectures of neoliberal settler capitalism in order to connect reproductive rights rollbacks in the U.S. with the expansion of reproductive violence across a world connected by colonial globalization. It has been argued that moral assertions involve the possession, on the part of the speaker, of appropriate non-cognitive attitudes. Thus, uttering ‘murder is wrong’ invites an inference that the speaker disapproves of murder. In this paper, we present the result of 4 empirical studies concerning this phenomenon. We assess the acceptability of constructions in which that inference is explicitly canceled, such as ‘murder is wrong but I don’t disapprove of it’; and we compare them to similar constructions involving ‘think’ (...) instead of ‘disapprove’—that is, Moore paradoxes (‘murder is wrong but I don’t think that it is wrong’). Our results indicate that the former type of constructions are largely infelicitous, although not as infelicitous as their Moorean counterparts. (shrink)

This paper investigates the cultural significance of black holes and suns as metaphors in continental European literature and art, drawing on theoretical insights from French continental authors such as Jean-François Lyotard and Ray Brassier. Lyotard suggests that black holes signify the ultimate form of the sublime, representing the displacement of humanity and our unease with our place in the cosmos. On the other hand, Brassier views black holes as a consequence of the entropic dissolution of matter, reflecting physical reality's indifference (...) to subjective or teleological significance. The study also presents a curated collection of literary works and artworks that employ black holes and suns as metaphors, examining the emergence of these metaphorical objects and identifying discursive and epistemological shifts in society. Furthermore, this collaborative research project, involving the Pontifical Catholic University of São Paulo and the Federal Fluminense University in Brazil, and the Charles University in Prague in the Czech Republic, aims to provide a valuable resource for further academic inquiry. To this end, working with the state of nature example and with several commentators from both authors, an analysis will be carried out whose intersection point is the command­obedience pair, more specifically concerning the voice issue, such as referenced by Veyne. Merging two theoretical approaches, as far as Hobbes is concerned, a structural perspective was chosen, respecting the author's geometric methodology; (...) regarding Foucault, it is operated from a heuristic aspect, aiming to approach his experimentalism. Detractors of Searle’s Chinese Room Argument have arrived at a virtual consensus that the mental properties of the Man performing the computations stipulated by the argument are irrelevant to whether computational cognitive science is true. This paper challenges this virtual consensus to argue for the first of the two main theses of the persons reply, namely, that the mental properties of the Man are what matter. It does this by challenging many of the arguments and conceptions put forth by the (...) systems and logical replies to the Chinese Room, either reducing them to absurdity or showing how they lead, on the contrary, to conclusions the persons reply endorses. The paper bases its position on the Chinese Room Argument on additional philosophical considerations, the foundations of the theory of computation, and theoretical and experimental psychology. This paper aims of is to present Richard Rorty’s Philosophy of Education, through his analysis of the education as being divided into two distinct processes: socialization and individualization. Thereafter, it is intended to show two critiques, of conservadorism and elitism, that are addressed to these processes. Finally, a redescription of the Rorty’s positions will be proposed, by assigning a reformist character to its apparent conservatism and a private character to the supposedly elitist individualization, in order to weaken the strength of (...) those critics. In this paper, I argue that the cleavage between the theory of reference and the theory of meaning, which under the influence of Quine has dominated a large part of the philosophy of language of the last fifty years, is based on a misrepresentation of Tarski's achievement and on an overestimation of the scope and value of disquotation. In particular, I show that, if we accept Davidson's critique of disquotation, the same kind of reasons that Quine offered in opposition to (...) the Carnapian theory of meaning also apply, mutatis mutandis, to the Tarskian theory of reference. Em grande medida, a discussão contemporânea sobre a importância moral dos animais surgiu e desenvolveu-se em torno da crítica e da defesa do especismo. Este artigo oferece uma visão da discussão filosófica contemporânea sobre o especismo. Após uma breve introdução, apresenta-se uma definição de especismo e caracterizam-se vários tipos de especismo, sendo o Antropocentrismo o mais (...) relevante. Depois, expõe-se um argumento proeminente contra o Antropocentrismo: o argumento dos casos marginais. Por fim, algumas posições antropocêntricas são criticamente discutidas. (shrink)

Este breve ensaio busca, por meio da análise estruturalista e distanciada indicada por Lévi-Strauss, aproximar o conjunto de funções literárias das relações presentes entre os personagens principais do mito de Orphéus e Eurydíkē, fundadores dos mistérios órficos da Antiguidade Clássica, e de Lot e sua esposa, apresentados no Livro de Gênesis. The so-called theory of karma is one of the distinguishing aspects of Hinduism and other non-Hindu south-Asian traditions. At the same time that the theory can be seen as closely connected with the freedom of will and action that we humans supposedly have, it has many times been said to be determinist and fatalist. The purpose of this paper is to analyze in some deepness the relations that are between the theory of karma on one side and determinism, fatalism and (...) free-will on the other side. In order to do that, I shall use what has been described as the best formal approach we have to indeterminism: branching time theory. More specifically, I shall introduce a branching time semantic framework in which, among other things, statements such as “state of affairs e is a karmic effect of agent a”, “a wills it to be the case that e” and “e is inevitable” could be properly represented. he general theme of this paper is the issue of formalization in philosophy; in a more specific way, it deals with the issue of formalization of arguments in analytic philosophy of religion. One argument in particular – Anselm’s Proslogion II ontological argument – and one specific attempt to formalize it – Robert Adams’ formalization found in his paper “The Logical Structure of Anselm’s Arguments”, published in The Philosophical Review in 1971 – are taken as study cases. The purpose of the (...) paper is to critically analyze Adams’ formalization with the intent to shed some light on the following questions: What are the virtues of formally analyzing arguments and the contributions, if any, of such an enterprise to the debate on Anselm’s argument? Which lessons can Adam’s work teach us about the dangers and limitations of formalization? Do these virtues and dangers teach us something about analysis of arguments in general? (shrink)

The semantic paradoxes are a family of arguments – including the liar paradox, Curry’s paradox, Grelling’s paradox of heterologicality, Richard’s and Berry’s paradoxes of definability, and others – which have two things in common: first, they make an essential use of such semantic concepts as those of truth, satisfaction, reference, definition, etc.; second, they seem to be very good arguments until we see that their conclusions are contradictory or absurd. These arguments raise serious doubts concerning the coherence of the concepts (...) involved. This article will offer an introduction to some of the main theories that have been proposed to solve the paradoxes and avert those doubts. Included is also a brief history of the semantic paradoxes from Eubulides to Tarski and Curry. (shrink)

Ao mesmo tempo que o malogro da assim chamada teoria clássica dos conceitos - de acordo com a qual definições são a maneira apropriada de caracterizar conceitos - é um consenso, a filosofia metafísica da religião parece ainda lidar com o conceito de Deus de forma predominantemente definicional. Podemos então nos perguntar: Seria esse malogro suficiente para inviabilizar uma caracterização definicional do conceito de Deus? Meu propósito central neste artigo é responder essa pergunta. Adoto uma ênfase representacional. Em outras palavras, (...) desejo analisar até que ponto os problemas mais importantes levantados contra a teoria clássica dos conceitos afetam uma abordagem definicional-representacional do conceito de Deus. Como resultado desse esforço, mostro que as críticas à teoria clássica que ameaçam tal abordagem dependem da pluralidade característica ao contexto inter-religioso, que por si só cria outros problemas. In this essay, I focus on Lugones’s relatively lesser explored notion of playfulness. I weigh in on the debate about whether playfulness is necessary for what Lugones calls “world-traveling,” which enables one to recognize another person as a full subject. I argue that although the attribute of playfulness may not be necessary for world-traveling, it is necessary for collaborative world-making––creating a new, shared world that is opened through the activity of play.

The thesis develops solutions to two main problems for mental realism. Mental realism is the theory that mental properties, events, and objects exist, with their own set of characters and causal powers. The first problem comes from the philosophy of science, where Psillos proposes a notion of scientific realism that contradicts mental realism, and consequently, if one is to be a scientific realist in the way Psillos recommends, one must reject mental realism. I propose adaptations to the conception of scientific (...) realism to make it compatible with mental realism. In the process, the thesis defends computational cognitive science from a compelling argument Searle can be seen to endorse but has not put forth in an organized logical manner. A new conception of scientific realism emerges out of this inquiry, integrating the mental into the rest of nature. The second problem for mental realism arises out of non-reductive physicalism- the view that higher-level properties, and in particular mental properties, are irreducible, physically realized, and that physical properties are sufficient non-overdetermining causes of any effect. Kim’s Problem of Causal Exclusion aims to show that the mental, if unreduced, does no causal work. Consequently, given that we should not believe in the existence of properties that do not participate in causation, we would be forced to drop mental realism. A solution is needed. The thesis examines various positions relevant to the debate. Several doctrines of physicalism are explored, rejected, and one is proposed; the thesis shows the way in which Kim’s reductionist position has been constantly inconsistent throughout the years of debate; the thesis argues that trope theory does not compete with a universalist conception of properties to provide a solution; and shows weakness in the Macdonald’s non-reductive monist position and Pereboom’s constitutional coincidence account of mental causation. The thesis suggests that either the premises of Kim’s argument are consistent, and consequently his reductio is logically invalid, or at least one of the premises is false, and therefore the argument is not sound. Consequently, the Problem of Causal Exclusion that Kim claims emerges out of non-reductive physicalism does not force us to reject mental realism. Mental realism lives on. (shrink)

Neste trabalho, é apresentada uma investigação do que poderia ser chamado de formalização lógica do processo de mudança de teorias devido a anomalias. Por anomalia entende-se um fato observado que faz parte do escopo explanatório de uma teoria, mas que vai de encontro à previsão da mesma. Uma abordagem clássica para restaurar o poder explicativo de uma teoria ameaçada por uma anomalia é a postulação de hipóteses novas e provisórias que, em conjunto com as demais hipóteses auxiliares originais, sejam capazes (...) de resolver a anomalia. Após chegar à algumas conclusões sobre a estrutura de tal processo, propomos um framework lógico multimodal e não-monotônico capaz de representar alguns aspectos-chave dessa faceta importante da dinâmica de teorias científicas. Devido à necessidade de acomodar hipóteses provisórias incompatíveis, esse framework incorpora uma forma fraca de paraconsistência. Como um estudo de caso, analisamos o comportamento anômalo do planeta Urano que ameaçou a mecânica celeste Newtoniana por mais de meio século e ensejou a descoberta do planeta Netuno. -/- In this work, an investigation of what could be called the logical formalization of the theory change process due to anomalies is presented. An anomaly is understood as an observed fact that is part of the explanatory scope of a theory, but that goes against its prediction. A classic approach to restoring the explanatory power of a theory threatened by an anomaly is to postulate new and provisional hypotheses that, together with the other original auxiliary hypotheses, are capable of resolving the anomaly. After reaching some conclusions about the structure of such a process, we propose a multimodal and non-monotonic logical framework capable of representing some key aspects of this important facet of the dynamics of scientific theories. Due to the need to accommodate incompatible provisional hypotheses, this framework incorporates a weak form of paraconsistency. As a case study, we analyze the anomalous behavior of the planet Uranus that threatened Newtonian celestial mechanics for more than half a century and prompted the discovery of the planet Neptune. A lo largo de la tradición psicopatológica, incluso de la pre-fenomenológica, se encuentra la categorización del delirio como creencia. Jaspers asumió ese uso y lo fundó fenomenológico-existencialmente, definiendo su carácter de convicción. El concepto de creencia ha tenido un largo recorrido dentro de la historia del pensamiento, aunque recientemente se ha intensificado el debate acerca de la visión doxástica del delirio. En virtud de lo ya mencionado, en el presente artículo presentamos un análisis conceptual de la creencia, con el objetivo (...) de identificar de manera precisa los aspectos esenciales que permiten al delirio definirse según ella. De esta manera, se discutirán algunas de las principales incursiones realizadas en el concepto desde la antigüedad periplatónica hasta José Ortega y Gasset, remarcando en cada pensador las directrices esenciales de su aproximación a la creencia. A su vez, introducir al filósofo español al debate psicopatológico permitirá incluir en la discusión dos aspectos importantes que creemos pueden ser fructíferos para la discusión filosófica sobre el delirio: la diferencia entre ideas y creencias, y la vitalidad de estas últimas. Finalmente, hacemos referencia al actual debate pro- y antidoxástico, haciendo hincapié en la necesidad de considerar la amplitud del concepto de creencia en su genealogía histórica. The purpose of this paper is twofold. First, it aims at introducing the ontological argument through the analysis of five historical developments: Anselm’s argument found in the second chapter of his Proslogion, Gaunilo’s criticism of it, Descartes’ version of the ontological argument found in his Meditations on First Philosophy, Leibniz’s contribution to the debate on the ontological argument and his demonstration of the possibility of God, and Kant’s famous criticisms against the (cartesian) ontological argument. Second, it intends to critically examine (...) the enterprise of formally analyzing philosophical arguments and, as such, contribute in a small degree to the debate on the role of formalization in philosophy. My focus will be mainly on the drawbacks and limitations of such enterprise; as a guideline, I shall refer to a Carnapian, or Carnapian-like theory of argument analysis. (shrink)
